The Sixth Amendment to the United States Constitution provides that in all criminal prosecutions, the accused has the right to have the assistance of counsel for his or her defense. The United States Supreme Court has held, in the leading case of Gideon v Wainwright, that this Sixth Amendment right to assistance of counsel is obligatory upon the states through the Due Process Clause of the 14th Amendment. This principle of the Gideon case has been followed or recognized by the courts in various later cases. However, an accused's remark, “Maybe I should talk to a lawyer,” is not an unambiguous request for counsel invoking the Sixth Amendment right.
